Terms of Service

The terms that govern your use of MarTech Sentinel, including what our data does and does not warrant.

Not yet finalised — no effective date.

Draft — pending legal review. This document has not been reviewed by an attorney and is not yet in force. Any remaining values shown in square brackets are still to be confirmed.

1. Agreement

These Terms govern your use of martechsentinel.com (the “Service”), operated by Raiden Gate Design Kft., 1048 Budapest, Bőröndös 18., Hungary (“we”, “us”). By creating an account or using the Service you agree to these Terms.

2. The Service

MarTech Sentinel provides research and decision-support information about marketing-technology vendors, including automatically extracted summaries of vendors’ publicly available security, compliance, and product information.

3. Accuracy — read this section carefully

  • Content in the Service is extracted automatically, including by AI systems, from third-party public sources, and is provided “as is” and “as available”, without warranty of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, or non-infringement.
  • Each factual claim displays its source and a verification status (verified, self-attested, contradictory, or not found). A status of “verified” means our system found consistent supporting statements at the cited source at the indicated time — it is not a certification, audit, or legal opinion.
  • Compliance and security information (for example SOC 2, ISO 27001, GDPR, data residency) must be independently confirmed with the vendor before you rely on it in any procurement, contractual, or regulatory context. The Service is decision support, not legal, security, or procurement advice.
  • Vendors change their products and policies; information may be outdated regardless of timestamps.

4. Your licence to use the data

  • We grant you a personal (or, on team plans, internal-business) non-exclusive, non-transferable licence to access and use the content for evaluating and procuring software.
  • You may not: scrape, bulk-export, or systematically copy the database or any substantial part of it; resell, sublicense, or republish the data; use the Service to build a competing database or train models on our content; or circumvent technical limits or access controls.
  • Exports provided by paid plans (for example committee packs) may be shared within your organisation or with your client for the evaluation at hand, with attribution retained.
  • The database, its structure, and its compilation are protected by database rights and copyright, including the sui generis database right.

5. Vendor names and trademarks

Vendor names and marks appear solely to identify the vendors and their products (nominative use). Their appearance does not imply any affiliation, sponsorship, or endorsement in either direction. We prefer word marks over logos; rights remain with their owners.

6. Corrections and removal (“notice and action”)

If you are a vendor (or their representative) and believe information about you is inaccurate: e-mail sayhi@raidengatedesign.com with the profile URL, the specific claim, and supporting evidence. We will acknowledge within 7 days and review within 14 days. Where a claim cannot be substantiated from public sources, we will correct it, mark it contradictory, or remove it. This channel also serves rectification and erasure requests under GDPR Arts. 16–17.

7. Accounts, plans, and billing

  • You are responsible for your account credentials and for use under your account.
  • Free-tier limits are described on the pricing page; we may adjust limits with notice.
  • Paid subscriptions (when paid plans are active): billed through Clerk Billing, with payments processed by Stripe; renew automatically; cancel anytime effective at period end; EU consumer withdrawal rights honoured where applicable. [Withdrawal and immediate-access waiver wording — attorney to finalise.]

8. Acceptable use

No unlawful use, no interference with the Service, no automated access except public APIs we may offer, and no misrepresentation of the data’s provenance or of our findings.

9. Liability

To the maximum extent permitted by law, our aggregate liability arising from the Service is limited to the fees you paid in the 12 months before the claim; we are not liable for indirect or consequential damages, or for decisions made in reliance on the content. Nothing limits liability that cannot be limited under applicable law.

10. Termination, changes, governing law

We may suspend accounts for breach. We may update these Terms with notice; continued use is acceptance. Governing law: Hungary; courts of Budapest; mandatory EU consumer protections unaffected.
